Applying for Custody of a Minor

A student may only be enrolled by his or her legal guardian. Below is information on the process for applying for legal guardianship in Campbell County. If you are not the legal guardian of the student, the counseling office will require a copy of documentation provided by the court indicating you have applied for legal guardianship and custody is pending. We will NOT accept a letter from a parent transferring custody even if it is notarized.

  • There is a $25 filing fee.  Fee waivers are available for qualified applicants.
  • It takes approximately 45 minutes to file a petition.
  • Applicants need to bring parent and child information such as birth certificates, social security cards, etc.
  • Grandparents are required to file for legal custody if listed as the guardian.
  • If a child is moving in with someone other than a parent in Campbell County, they must go back to the county/city court they have come from for the new guardian to get custody (UNLESS the child has resided in Campbell County for at least 6 months).
  • Child has been placed in foster care within the school division by a local social service agency (documentation required)
  • Court appoints guardians (documentation required)
  • Both parents are deceased (documentation may be required)
